Terms for store owners

Intermediary service. aDonate accepts payment on the store owner's instruction and withholds a 6% fee from the amount transferred to them. The store owner is the seller under the contract and is responsible for the product and its delivery.

Subject and status of the parties

The operator gives the store owner access to the service: the storefront, the owner cabinet, payment acceptance and settlement. The store owner builds the catalogue, sets prices and delivers products; towards the buyer, the store owner is the seller.

The operator accepts payment on the instruction and for the account of the store owner, under the model set out in Chapter 43 of the Civil Code of the Republic of Kazakhstan. Registering a store and listing a first product accepts these terms.

Service fee

The operator's fee is 6% of every successful payment after applied discounts. It is withheld at payout: the store owner receives the payments for the period less the fee and the payment provider's costs.

There are no other mandatory charges for connecting to or using the service. A change of rate is published on this page at least 30 calendar days before it takes effect; until that date the previous rate applies and the store owner may leave the service without penalty.

Payouts and taxes

Payouts go to the details provided by the store owner, at the interval configured in the owner cabinet. The operator may hold a payout covering a disputed transaction until it is resolved, stating the reason and the expected period to the store owner.

The store owner accounts for their own income and pays their taxes and other mandatory charges. The operator is not their tax agent and withholds no tax from payouts.

Refunds and payment disputes

When money is refunded to a buyer, the withheld fee is returned to the store owner in proportion to the refunded amount, except where the refund was caused by the store owner's breach. Non-refundable payment provider costs are borne by the store owner.

The amount of a payment disputed at a bank and the related costs are deducted from the next payout. The operator supplies the store owner with the information needed to answer the dispute and is not responsible for the issuing bank's decision.

Store owner obligations

The store owner publishes accurate descriptions, prices and delivery times, publishes their own requisites and a working support contact, delivers paid orders and answers buyers within the deadlines set by law.

The store owner complies with applicable law, the game's monetisation rules and third-party rights. Products that breach the law or rights holders' rights, sales of access to other people's accounts, promises of advantages outside the game server and conversion of in-game values into money are not allowed.

Suspension and termination

The operator may suspend payment acceptance or the store on reasonable suspicion of a breach of the law, of these terms or of payment scheme rules, stating the reason to the store owner. Work resumes once the breach is remedied.

Either party may withdraw from the contract by notifying the other. Obligations for payments already accepted, for delivering paid orders and for completing settlements survive until they are performed.

Buyers' personal data

For the buyers of their own store, the store owner determines the purposes of processing and is responsible for having a lawful basis. The operator processes that data to run the service, settle payments and meet legal requirements.

The store owner may not use buyer data obtained through the service for purposes the buyer was not informed of, including mailings without separate consent.

Liability of the parties

The store owner reimburses the operator for documented losses arising from claims by buyers, rights holders or public authorities in connection with their products, descriptions and delivery.

The operator is responsible for the service and for timely settlement. Its liability to the store owner is limited to the fees withheld in the three months preceding the event, except where the law does not permit such a limit.

Changes and governing law

The revision of these terms is published on this page with its date. Continuing to run the store after a change takes effect accepts the new revision.

The relationship is governed by the law of the Republic of Kazakhstan. Disputes are settled through a written complaint and, failing agreement, by the court at the operator's place of registration.
